1. Services
Description of Services
OurDigitizer provides professional embroidery digitizing services, vector art conversion, and related design services. We convert customer-supplied artwork into machine-readable embroidery file formats (DST, PES, JEF, EXP, VP3, and others) for use with commercial and home embroidery machines.
Service Availability
We provide services 24/7 and aim to respond to all quote requests within 30 minutes. Standard order delivery is within 6–8 hours of payment confirmation. Rush service is available subject to availability. We reserve the right to decline any order at our discretion.
No Physical Production
OurDigitizer provides digital embroidery files only. We do not physically embroider garments, produce patches, or manufacture any physical goods. The delivery of our service is a digital file via secure download link.
2. Ordering and Payment
Quote and Approval Process
All orders begin with a free, no-obligation quote. You are not charged until you explicitly approve the quoted price and proceed to payment. Quotes are valid for 48 hours from the time of issue. After 48 hours, a new quote may be required.
Payment Terms
Payment is required in full before production begins. We accept all major credit and debit cards via Stripe, and PayPal. All payments are processed in US Dollars (USD). Payment constitutes your acceptance of the quoted price and these Terms.
Pricing
Prices are based on the service type and complexity level (Simple, Medium, Complex, Super Complex) as stated on our pricing page. The final price is confirmed in your quote. We reserve the right to revise our prices at any time, but price changes will not affect orders for which a quote has already been issued and accepted.
Taxes
Our prices do not include applicable sales taxes. Any applicable taxes will be added to your invoice as required by law based on your location.
3. Customer Obligations
Design File Quality
You are responsible for providing the highest quality artwork possible. While we can work with most file formats and resolutions, higher quality source files produce better digitizing results. We are not responsible for poor output quality caused by low-resolution or unclear source artwork. We will advise you if your file quality may affect the result before proceeding.
Intellectual Property Rights
By submitting artwork to OurDigitizer, you represent and warrant that: (a) you own the artwork or have the legal right to use it and have it digitized; (b) the artwork does not infringe any third-party intellectual property rights, trademarks, or copyrights; and (c) you have all necessary rights and permissions to use the artwork for the intended purpose. OurDigitizer is not responsible for any intellectual property infringement arising from customer-supplied artwork.
Prohibited Content
You may not submit artwork that depicts or promotes: illegal activities, violence, terrorism, child exploitation, racial or ethnic hatred, or content that infringes third-party intellectual property rights without authorization. We reserve the right to refuse and cancel any order involving prohibited content.
Accurate Information
You are responsible for providing accurate order information including correct email address, design specifications, required file formats, and intended use (garment type, fabric, size). Errors in order specifications that require re-digitizing may incur additional charges.
4. Revisions and Satisfaction Guarantee
Free Unlimited Revisions
We offer free unlimited revisions on all orders until you are completely satisfied with the digitized result. Revision requests must be specific and clearly describe what needs to be changed. General dissatisfaction without specific feedback does not constitute grounds for a revision request.
Revision Scope
Free revisions cover adjustments to the digitized file to better match your original artwork or intended stitch-out result. Revisions do not include changes to the original artwork itself, redesigns that substantially alter the original design, or requests that go beyond the original order scope. Additional fees may apply for out-of-scope changes.
Revision Timeline
Revision requests are processed with the same priority as new orders. Standard revision turnaround is within 6–8 hours of the revision request being submitted.
Satisfaction Guarantee
If after unlimited revisions we are unable to deliver a digitized file that meets the standard of your submitted artwork, we will issue a full refund. Refund requests must be submitted within 30 days of the original order date.
5. Delivery and File Access
Digital Delivery
Completed digitized files are delivered via secure download link sent to the email address you provided with your order. You are responsible for ensuring your email address is correct. We are not responsible for delivery failures caused by incorrect email addresses, spam filters, or full inboxes.
File Retention
We retain your digitized files for a minimum of 90 days after delivery. After this period, files may be deleted without notice. We recommend downloading and backing up your files immediately upon receipt.
Re-Download
If you need to re-download a file within the retention period, contact us at Admin@ourdigitizer.com with your order number and we will provide a new download link.
6. Intellectual Property
Ownership of Digitized Files
Upon receipt of full payment, you receive a non-exclusive license to use the digitized file for embroidery production on any quantity of garments or items for personal or commercial purposes. You may not resell, redistribute, or sublicense the digitized file itself to third parties.
OurDigitizer Intellectual Property
All content on the OurDigitizer website, including text, graphics, logos, images, and software, is the property of OurDigitizer and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our express written permission.
Portfolio Use
We may use anonymized examples of digitized designs in our portfolio and marketing materials. If you do not want your design used in our portfolio, please notify us in writing when placing your order.
7. Limitation of Liability
No Warranty
Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the fitness of our digitized files for any particular embroidery machine, fabric type, or production process beyond what is stated in our service descriptions.
Limitation of Damages
To the maximum extent permitted by applicable law, OurDigitizer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising from your use of our services or inability to use our services, even if we have been advised of the possibility of such damages.
Maximum Liability
Our total liability to you for any claim arising from our services shall not exceed the amount you paid for the specific order giving rise to the claim.
8. Cancellations and Refunds
Cancellation Before Production
You may cancel your order at any time before production has begun (i.e., before you have paid and we have started digitizing). Contact us immediately at Admin@ourdigitizer.com or +1 (213) 575-4946 to cancel.
Cancellation After Production
Once production has begun, cancellations are not possible as the work is custom and non-recoverable. If you are not satisfied with the completed file, the revision and satisfaction guarantee process applies.
Refund Policy
Refunds are issued in the following circumstances: (1) we are unable to deliver a satisfactory result after unlimited revisions; (2) we fail to deliver within the agreed timeframe without prior notification; (3) we cancel your order at our discretion. Refunds are processed within 5–10 business days to your original payment method.
9. Governing Law and Disputes
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Dispute Resolution
In the event of any dispute arising from these Terms or our services, the parties agree to first attempt to resolve the dispute informally by contacting us at Admin@ourdigitizer.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in Los Angeles, California, in accordance with the American Arbitration Association rules.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
10. Changes to Terms
Updates
We reserve the right to update these Terms at any time. We will notify you of significant changes by posting a notice on our website. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
